Preferences, such as language, interests, cultural or religious preferences, and other feedback or preferences that you might express during your use of our Services, for example when customizing a memorial;
Marketing data, such as your choices regarding our newsletters, surveys, and other marketing displayed or provided to you, and preferred methods of receiving such promotional communication;
Relationship information, such as details of your communications with us and details of your claims, complaints, and queries in general; and

Information We Collect Automatically When You Interact with Us
When you access or use our Services or otherwise transact business with us, we automatically collect certain information, including:

We do not currently respond to browser do-not-track signals.

For example, we may collect information about you from your interactions with other digital memorials, advertising networks, data analytics providers, mailing list providers, and our social media accounts. We may also collect information from sources such as publicly available databases and data brokers.
Information We Derive
We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your location based on your IP address.
Information You Provide about Others
If you disclose any personal information relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
3. Sharing of Information
We share personal information in the following circumstances or as otherwise described in this policy:
We share personal information with vendors, service providers, and consultants that need access to personal information in order to perform services for us, such as companies that assist us with web hosting, fraud prevention, customer service, email and communications delivery, and analytics services.
We may share your personal information with our business and marketing partners to allow them to provide you with certain services, advertisements, or promotions. Our business and marketing partners may use your information in accordance with their own privacy notices.
If you post content in a public area of our Services, we share this information publicly on our Services.

Personal information may be shared between and among Chptr and our current and future parents, affiliates, and subsidiaries and other companies under common control and ownership.

We also share aggregated or de-identified information that cannot reasonably be used to identify you.
Chptr is headquartered in the United States, and we have operations and service providers in the United States. Therefore, we and our service providers may transfer your personal information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction. We will take steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it.

We seek to use reasonable organizational, technical, and administrative measures to protect personal information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please notify us immediately.

Opt Out from sharing of your personal information with our business and marketing partners for their direct marketing purposes.
Choices regarding communications and notifications:
Communications Preferences: You may opt out of receiving text messages or promotional emails from Chptr by following the instructions in those communications or by managing your communication preferences in your account settings menu. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.
Mobile Push Notifications: With your consent, we may send push notifications to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.
To make a request, please contact us in accordance with the Contact Us section below. We will respond to your request consistent with applicable law. You have the right to be free from unlawful discrimination for exercising your rights under applicable law.
In your request, please make clear what personal information you would like to have changed, whether you would like to have your personal information suppressed from our database or otherwise let us know what limitations you would like to put on our use of your personal information. For your protection, we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.
To the extent available under applicable law, if we refuse to take action on your request, you may appeal this refusal within a reasonable period after you have received notice of the refusal. You may file an appeal by contacting us as described in the Contact Us section below.
If you would like another person (an “agent”) to make a request on your behalf as permitted by applicable law, the agent may use the submission methods noted above. As part of our verification process, we may request that the agent provide proof of their authorization by you to submit the request.
Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion (e.g., when you make a purchase or enter a promotion, you may not be able to change or delete the personal information provided until after the completion of such purchase or promotion). Further, certain personal information may be exempt from requests pursuant to applicable data protection laws or other laws and regulations.
California residents may request information about our disclosure of personal information to third parties for their direct marketing purposes under California’s “Shine the Light” law. To make such a request, please email us at support@chptr.com.
We retain personal information for as long as needed or permitted in light of the purposes for which it was obtained as outlined in this Privacy Policy unless a longer retention period is required or permitted by applicable law. The criteria used to determine our retention periods include:
The length of time we have an ongoing relationship with you (for example, for as long as you keep using our Services);
Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records or communications for a certain period before we can delete them); or
Whether retention is advisable considering our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).
This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties. This includes any third party operating any website or service to which our Services link. The inclusion of a link on our Services does not imply endorsement of the linked site or service by us or by our affiliates.
In addition, we are not responsible for the information collection, use, disclosure or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer, including with respect to any personal information you disclose to other organizations through or in connection with the Services or on social media.
10. Third-Party Payment Service
The Services may provide functionality allowing you to make payments to us using third-party payment services. When you use such a service to make a payment, your personal information will be collected by such third party and not by us, and will be subject to the third party’s privacy policy, rather than this Privacy Policy. We have no control over, and are not responsible for, this third party’s collection, use, and disclosure of your personal information.
11. De-Identified Information
Where we maintain or use de-identified information, we will continue to maintain and use that information only in a de-identified form and will not attempt to re-identify the information.
12. Use of the Services by Minors
The Services are not directed to individuals under the age of 16, and we do not knowingly collect personal information from individuals under 16. If you have reason to believe that a child under the age of 16 has provided personal information to us through the Services, please contact us.
